Accommodation agreement

  1. Article 1 (Scope of application)

    1. Accommodation contracts and related agreements entered into by this accommodation facility with guests shall be in accordance with the provisions of these Terms and Conditions, and any matters not provided for in these Terms and Conditions shall be in accordance with laws and regulations or generally established customs.
    2. If this accommodation facility accepts special provisions to the extent that they do not contravene laws, regulations and customs, such special provisions shall prevail notwithstanding the provisions of the preceding paragraph.
  2. Article 2 (Application for accommodation contract)

    1. A person who wishes to apply for an accommodation contract with this accommodation facility is
      required to provide the following information to this accommodation facility:
      ・Guest’s name, sex, nationality, telephone number and e-mail address
      ・Date(s) of stay and estimated time of arrival
      ・Accommodation charges (based in principle on the basic accommodation charges in Appendix
      ・Other matters deemed necessary by this accommodation facility
    2. If a guest during his/her stay requests to continue his/her stay beyond the date(s) of stay specified in item 2 of the preceding paragraph, this accommodation facility shall treat such request as a new application for an accommodation contract at the time the request is made.
  3. Article 3 (Conclusion of accommodation contract, etc.)

    1. An accommodation contract shall be deemed concluded when this accommodation facility accepts the application described in the preceding article, except when this accommodation facility proves that it did not accept the application.
    2. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, a deposit equivalent to the basic accommodation charge (room charge) for the period of stay shall be paid by credit card no later than the date stipulated by this accommodation facility (generally at the same time the accommodation contract is concluded).
    3. The deposit shall first be applied to the room charge ultimately payable by the guest and, if a situation arises where the provisions of Articles 6 and 18 apply, the deposit shall be applied first to any penalty charges due and then to any compensation owed, with any remaining amount returned upon payment of the charges pursuant to Article 12.
    4. In the event that the deposit stipulated in paragraph 2 is not paid by credit card by the date stipulated by this accommodation facility pursuant to the same paragraph (generally at the same time as the accommodation contract is concluded), the accommodation contract shall be rendered null and void, provided that this accommodation facility has notified the guest to that effect when stipulating the date for payment of the deposit.
    5. 5. The maximum continuous stay allowed at this accommodation facility is one (1) month.
  4. Article 4 (Special provision on non-requirement of deposits)

    1. Notwithstanding the provisions of Paragraph 2 of the preceding article, this accommodation facility may agree to a special provision by which payment of the deposit specified in the same paragraph is not required after the contract is concluded.
    2. If this accommodation facility does not request payment of the deposit specified in Paragraph 2 of the preceding article or does not specify the due date for payment of said deposit when accepting an application for an accommodation contract, this accommodation facility shall be deemed to have agreed to the special provision in the preceding paragraph.
  5. Article 5 (Refusal to enter into an accommodation contract)

    This accommodation facility may refuse to enter into an accommodation contract in the following cases:

    1. When the application for accommodation is not in accordance with these Terms and Conditions
    2. When there are no rooms available due to full occupancy
    3. When it is recognized that the person who intends to stay at this accommodation facility is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with his/her stay
    4. When it is recognized that the person who intends to stay falls under any of the following categories (a) through (c):
      1. (a)An organized crime group as prescribed in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as "organized crime group"), a member of such an organized crime group as prescribed in Article 2, Item 6 of the same Act (hereinafter referred to as "organized crime group member"), a quasi-member of an organized crime group, an individual affiliated with an organized crime group, or another such antisocial force
      2. (b)A corporation or other organization whose operations are controlled by an organized crime group or an organized crime group member
      3. (c)A corporation any of whose officers is a member of an organized crime group
    5. When it is recognized that the person who intends to stay has engaged, or is likely to engage, in behavior such as being heavily intoxicated that clearly inconveniences neighboring residents.
    6. When it is clearly recognized that the person who intends to stay has a contagious disease
    7. When the person who intends to stay has made coercive demands or requests imposing an unreasonable burden on this accommodation facility in connection with his/her stay
    8. When it is impossible to accommodate the person who intends to stay due to a natural disaster, a breakdown of facilities, or other unavoidable reason
    9. When the person who intends to stay brings hazardous materials (stoves and other open-flame devices, petroleum and petroleum-like substances, etc.) or other items harmful to human health onto this accommodation facility’s premises
    10. When the person who intends to stay has had an accommodation contract cancelled by this accommodation facility in the past
    11. When there are other justifiable reasons for refusing to enter into an accommodation contract
  6. Article 6 (Right of the guest to cancel the contract)

    1. The guest may cancel the accommodation contract by making a request to that effect to this accommodation facility.
    2. If a guest cancels all or part of the accommodation contract due to reasons attributable to the guest (except when this accommodation facility specifies a due date for payment of the deposit and requests payment of the deposit pursuant to Article 3, paragraph 2, and the guest cancels the accommodation contract prior to such payment), a penalty charge shall be assessed in accordance with the provisions of Appendix 2.
    3. If a guest does not arrive at 9:00 pm on the day of the stay (or one (1) hour after the estimated time of arrival, if such time has been specified in advance) without informing this accommodation facility, this accommodation facility may treat the contract as having been cancelled by the guest. Arrival confirmation will be conducted through the check-in process on the tablet.
  7. Article 7 (Right of this accommodation facility to cancel the contract)

    This accommodation facility may cancel the accommodation contract in the following cases:

    1. (1) When it is recognized that the guest has committed, or is likely to commit, an act contrary to the provisions of laws and regulations, public order, or good morals in connection with his/her stay
    2. (2) When it is recognized that the guest falls under any of the following categories (a) through (c):
      1. (a)An organized crime group, an organized crime group member, a quasi-member of an organized crime group, an individual affiliated with an organized crime group, or another such antisocial force
      2. (b)A corporation or other organization whose operations are controlled by an organized crime group or an organized crime group member
      3. (c)A corporation any of whose officers is a member of an organized crime group
    3. When it is recognized that the guest has engaged, or is likely to engage, in behavior such as being heavily intoxicated, singing loudly, causing disturbances, dancing or playing music that clearly inconveniences neighboring residents
    4. When it is clearly recognized that the guest has a contagious disease
    5. When the guest has made coercive demands or requests imposing an unreasonable burden on this accommodation facility in connection with his/her stay
    6. When it is impossible to accommodate the guest due to a natural disaster or other force majeure
    7. When the guest smokes within this accommodation facility, tampers with firefighting equipment, or refuses to comply with other prohibitions stipulated in the Rules of Use established by this accommodation facility (limited to those required for fire prevention)
    8. When it is recognized that the guest is clearly insolvent
    9. When the guest is deemed to be behaving suspiciously
    10. When the guest engages in gambling or commits an illegal act or other act that violates public morals
    11. When the guest fails to abide by other rules of use set forth by this accommodation facility

    2. When this accommodation facility cancels the accommodation contract pursuant to the provisions of (4) or (6) in the preceding paragraph, no charge shall be assessed for accommodation services, etc., that the guest has not yet received.

  8. Article 8 (Accommodation registration)

    Guests are required to register the following items:

    • Guest's name, age, sex, address, telephone number and e-mail address
    • Nationality, passport number, place of entry and date of entry if the guest is a foreign national not domiciled in Japan
    • Departure date and scheduled departure time
    • Other matters deemed necessary by this accommodation facility
  9. Article 9 (Guest room occupancy hours)

    Guests are required to register the following items:

    1. 1. Guest rooms shall be available from 3:00 pm to 10:00 am of the following morning. For guests staying for more than one night, however, guest rooms shall be available all day long except for the day of arrival and the day of departure.
    2. 2. Notwithstanding the provisions of the preceding paragraph, this accommodation facility may allow guests to use guest rooms beyond the time prescribed in the preceding paragraph. In such cases, the following additional charges shall apply:
      ・Up to two (2) extra hours: 30% of the basic room charge
      ・Up to three (3) extra hours: 50% of the basic room charge
      ・For more than three (3) extra hours: 100% of the basic room charge
    3. 3. For continuous stays of three or more nights, rooms shall be cleaned between the times stipulated below, and room cleaning personnel may enter guest rooms during this period (except on the day of arrival and the day of departure):
      Approximately 10:00 am to 3:00 pm
  10. Article 10 (Compliance with Rules of Use)

    Guests shall follow the Rules of Use established by this accommodation facility and posted within the facility.

  11. Article 11 (Business hours)

    Business hours shall be as follows:

    1. Curfew for this accommodation facility: no curfew (persons under 18 years of age not accompanied by a parent or guardian must return by 10:00 pm)
    2. The hours listed in paragraph 1 may be changed temporarily if necessary or unavoidable, in which case notification shall be provided by appropriate means.
  12. Article 12 (Payment of charges)

    1. The breakdown of accommodation charges, etc., to be paid by the guest shall be as indicated in Appendix 1.
    2. Payment of the accommodation charges, etc., in the preceding paragraph shall be made in Japanese yen or by credit card on the date stipulated by this accommodation facility (generally at the same time the accommodation contract is concluded) or when requested by this accommodation facility.
    3. Accommodation charges shall apply even if the guest voluntarily chooses not to stay in the guest room after this accommodation facility has made the room available for use by the guest.
  13. Article 13 (Liability of this accommodation facility)

    1. If a guest suffers damages because of the non-performance of the accommodation contract or related agreements or the commission of illicit acts by this accommodation facility, this accommodation facility shall compensate the guest for damages up to 100,000 yen, except in the case of willful misconduct or gross negligence on the part of this accommodation facility. This shall not apply, however, when the damages are due to reasons not attributable to this accommodation facility.
    2. This accommodation facility’s liability with respect to accommodation begins when the guest enters this accommodation facility and ends when the guest vacates this accommodation facility to depart.
    3. This accommodation facility is covered by a hotel liability insurance policy against fire and other damage but, if any of the exclusions in the insurance policy apply, this accommodation facility may not be able to compensate for damages incurred by the guest.
  14. Article 14 (Steps to be taken when unable to provide a contracted guest room)

    1. If this accommodation facility is unable to provide a guest with a contracted room, it shall, with the guest’s consent, arrange for other accommodation under the same conditions as far as possible.
    2. If this accommodation facility is unable to find other accommodation notwithstanding the provisions of the preceding paragraph, it shall pay the guest a compensation fee equivalent to the penalty charge listed in Appendix 2, which shall be applied to the compensation for damages. No such compensation fee shall be paid to the guest, however, if this accommodation facility is unable to provide a guest room for reasons not attributable to this accommodation facility.
    3. In the case of the preceding paragraph, this accommodation facility shall not be liable for any compensation beyond the compensation fee.
  15. Article 15 (Handling of deposited property, etc.)

    This accommodation facility does not accept for safekeeping any goods, cash or valuables (hereinafter referred to as "goods, etc." in this article).

  16. Article 16 (Storage of guests' baggage)

    1. This accommodation facility shall not as a rule accept custody of guests' baggage in advance.
    2. If a guest leaves baggage or personal belongings behind at this accommodation facility after checking out, this accommodation facility shall as a rule keep them for seven (7) days, including the day they are found, and then report them to the nearest police station; however, valuables shall be immediately reported to the nearest police station. Food, beverages, magazines, and other waste-like items shall be disposed of at this accommodation facility’s 's discretion on the day they are found or the following day (during cleaning).
    3. To properly dispose of luggage or personal belongings left behind in keeping with the nature of their contents, this accommodation facility may inspect their contents at its discretion and, if necessary, dispose of them in accordance with the preceding paragraph, and the guest may not object to this.
    4. The liability of this accommodation facility for the custody of guests' baggage or personal belongings in the case of Paragraphs 1 and 2 shall be in accordance with the provisions of the preceding article.
  17. Article 17 (Parking)

    1. This accommodation facility shall not be responsible for the care of guests’ vehicles parked on this accommodation facility’s parking lot and shall assume no liability whatsoever for any theft, loss, or damage to vehicles, their accessories, or their loads that occurs in the parking lot.
    2. This accommodation facility shall also assume no liability whatsoever for any theft, loss, or damage to guests’ vehicles, their accessories, or their loads in parking lots not under the control of this accommodation facility.
  18. Article 18 (Liability of guests)

    If this accommodation facility incurs expenses for cleaning and repairing guest rooms or suffers lost sales opportunities or other damages due to behavior by a guest in violation of these Terms and Conditions or the Rules of Use or other reasons attributable to the guest, the guest concerned shall compensate this accommodation facility for the damages so incurred.

  19. Article 19 (Jurisdiction and governing law)

    All disputes arising in connection with these Terms and Conditions shall be resolved in accordance with the laws and regulations of Japan in the district court or summary court having jurisdiction over the location of this accommodation facility.

  20. Article 20 (Disclaimer by this accommodation facility)

    1. This accommodation facility shall not be responsible for any noise, vibration, or odors that may be generated in the vicinity of this accommodation facility.
    2. Please be aware that this accommodation facility shall not be liable for any injuries caused by guests falling on the premises, and that you stay entirely at your own risk.
    3. This accommodation facility does not provide meals but, if a meal is provided at the request of a guest, whether as an option when making the reservation or under any other name, the provision of the meal constitutes a contract between the business concerned and the guest, and this accommodation facility shall not be held responsible in any way.
    4. This accommodation facility reserves the right to make revisions and changes to these Terms and Conditions without prior notice to guests due to changes in socioeconomic conditions and other circumstances.
  21. Article 21 (Governing language)

    These Terms and Conditions have been prepared in both Japanese and English, but the foreign-language (English) text is made available solely for reference purposes; the Japanese text shall take precedence if any discrepancy or difference arises between the Japanese text and the foreign-language text. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

    1. If all nights are cancelled for a multiple-night reservation, a cancellation fee shall be charged for the full period of the reservation.
    2. If a reservation is cancelled for part of a multiple-night reservation, a cancellation fee shall be charged for the cancelled portion of the reservation.
    3. No reduction in the accommodation charges shall be made if the number of guests in a multiple-guest reservation is reduced.

Rules of Use

To maintain the communality and safety of our facilities, we ask our guests to abide by the following rules. Failure to abide by these rules shall compel us to refuse you continued access to this accommodation facility in accordance with Article 9 of the Accommodation Terms and Conditions. Please note that this accommodation facility shall not be held responsible for any accidents that may occur as a result of a guest's failure to comply with these rules.

  1. 01. For safety and security reasons, please observe the following:

    1. Please check the evacuation route map and emergency exits.
    2. Please make sure that all windows and doorways are locked when you leave this accommodation facility, when you are in your room, and when you go to bed.
    3. Please do not open the door to suspicious visitors.
    4. Please be sure to turn off the cold/hot water supply after use in the bathroom or washroom.
  2. 02. The following acts are strictly prohibited within this accommodation facility:

    1. Smoking. If smoking is detected within the accommodation or on the premises, a penalty fee of 50,000 yen will be charged.
    2. Using open-flame devices for heating and cooking (such as portable butane stoves) and electrical appliances other than those provided in advance in this accommodation facility (irons, etc.)
    3. Tampering with or disturbing fire-fighting equipment, etc.
    4. Moving, processing or removing furnishings and other items in this accommodation facility, or using them for purposes other than their intended use
    5. Bringing in the following items:
      1. (a)Animals, birds, etc. (excluding guide dogs, etc.)
      2. (b)Stimulants, narcotics, and other drugs whose possession is prohibited by law
      3. (c)Combustible or inflammable explosives and volatile fuels, and hazardous chemicals harmful to human health.
      4. (d)Unlicensed firearms, swords and similar items
      5. (e)Items in extremely large quantities or of extremely heavy weight
      6. (f)Items that emit unpleasant odors
      7. (g)Garbage and other items detrimental to guest room hygiene
      8. (h)Electrical appliances, cooking utensils, and other items intended for use inside this accommodation facility
      9. (i)Other items that this accommodation facility prohibits from being brought into guest rooms
    6. Talking in a loud voice, singing loudly, engaging in boisterous behavior, gambling or engaging in other behavior discomforting or disturbing to nearby residents and injurious to public morals or public safety; loud conversations, especially after 8:00 pm, are strictly prohibited in and near this accommodation facility.
    7. Taking home any of this accommodation facility’s fixtures/supplies other than amenities
    8. Burning incense, aroma candles, etc., within this accommodation facility
    9. Using bath salts in this accommodation facility’s bathtubs
    10. Bathing while intoxicated or using hair dye, bleach, etc., in the bathroom
    11. Engaging in acts contrary to public order and decency
    12. Engaging in profit-making activities
    13. Using a guest room for purposes other than lodging (parties, banquets, etc.)
    14. Allowing an outside visitor into a guest room (except for services arranged through the front desk)
    15. Distributing flyers, leaflets, or other advertising materials within this accommodation facility or on its premises
    16. Using photographs, etc., taken within this accommodation facility or on its premises for business purposes without permission
    17. Engaging in any other behavior detrimental to health and safety in this accommodation facility
    18. Allowing guest room access to a person other than the guest who reserved the room and/or permitting such a person to stay overnight without explicit approval from this accommodation facility
  3. 03. Handling of valuables and other deposited belongings

    This accommodation facility shall not be liable for any loss or damage to valuables and other deposited belongings during a guest’s stay.

  4. 04. Defacement of, damage to, or loss of fixtures and supplies in this accommodation facility

    Guests shall be charged at cost for any defacement, damage, or loss they cause to fixtures and supplies in this accommodation facility.
